IMPORTANT NOTICE: THESE TERMS OF USE (hereinafter referred to as "Terms") constitute a legally binding agreement between you (an individual, company, or any other entity) and 深圳快造科技有限公司 (Shenzhen Snapmaker Technologies Co., Ltd.) and SNAPMAKER HK LIMITED, governing your access to and use of Snapmaker websites, products, software, services, and related resources. PLEASE READ THESE TERMS CAREFULLY. You must have reached the age of majority in your jurisdiction to access and be bound by these Terms. If you have not reached the age of majority, your guardian must consent to or enter into these Terms on your behalf. Before using your Snapmaker product, read these Terms carefully. Your use of Snapmaker products will be deemed your acceptance to be bound by the conditions set forth herein. If you do not agree to these Terms, do not use any Snapmaker product. Subject to the applicable product return policy, you may return the Snapmaker product to the original point of purchase, an authorized distributor, or the retail store where the device was purchased to apply for a refund. Please note that returns to a retail store may be subject to that store's specific return requirements. The product return policy shall comply with the relevant laws and regulations of the country/region of purchase.

(2) Unless otherwise agreed, the software covered by these Terms is subject hereto, regardless of whether it is stored in read-only memory, any other media, in any other form, or sourced from an online download location authorized by Snapmaker.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive license to use the Products (as defined in Article 1(1)1) on Snapmaker devices or personal computers and mobile devices. This license is for personal, non-commercial use and you may not sell, transfer, or use the Products for any other commercial purpose.
By registering for an account within the Products or by your actual use of the Products, you indicate that you have fully read, understood, and agree to be bound by these Terms. These Terms constitute a legal instrument between you and the Company and shall take full effect.

(1) Without our prior written permission, you shall not use our technology or intellectual property (including patents, trademarks, software, and firmware) to develop, design, manufacture, or sell devices, software, or third-party accessories that compete with Snapmaker products.
(2) For the open-source software we provide, you may exercise your rights in accordance with the terms of the open-source licenses, but you shall not infringe upon our brand or intellectual property rights. You shall not use our name or logo for commercial promotion without authorization.
(3) You understand and agree that you are solely responsible for the copyright legality of all models processed through Snapmaker products.
The Snapmaker Privacy Policy (hereinafter the "Privacy Policy") provides information relating to our collection and use of data. When you use the Products, we will collect and use data from your device in accordance with these Terms and the Privacy Policy. (1) To continuously provide you with an improved user experience and device performance, we may periodically offer Product updates, including but not limited to system software updates, firmware updates, and other functional improvements. Such updates are intended to enhance product performance, security, and reliability. Updates may be delivered via various methods, including online downloads or manual installation. Update content may include bug fixes, performance improvements, security patches, and new features.
(2) Any replacement or supplemental Product updates provided by us are subject to these Terms, unless the update is accompanied by a separate usage agreement, in which case the terms of that agreement shall prevail. If you choose not to install an update, you understand and agree that this may result in potential security risks or the inability to use certain features of the Product. Snapmaker shall not be liable for any degradation in performance or security risks arising from the failure to install updates.
(3) To maintain Product stability, the Products may automatically check for available updates when connected to the internet and download and install them upon receiving your authorization.
(1) The Products may enable you to access related Snapmaker and third-party applications and services (collectively and individually, the "Services"). However, due to the regional nature of some Services, they may not be available in all languages or regions. Certain features may vary by region, some may be restricted, or may not be offered by your service provider. Furthermore, you understand and agree that the availability of certain features of the Products may also be affected or limited by hardware and data access constraints and may not be available on all products.
(2) To ensure and enhance your user experience, the Products include system services. The specific content of the services under the Products is provided by Snapmaker and its affiliates/licensors based on actual circumstances. Snapmaker and its affiliates/licensors may modify the services they provide, and the content of the provided services may change at any time.
You expressly understand and agree that the Products support the execution of standard G-code files but do not guarantee the availability of G-code generated by third-party software at any time. Furthermore, we shall not be liable for any product damage resulting from running G-code generated by third-party software on the Products.
(1) You acknowledge that the Products are provided "AS IS" without any express or implied warranties of any kind. To the maximum extent permitted by applicable law, Snapmaker, its licensors/affiliates, or copyright holders disclaim all express or implied representations and warranties, including, but not limited to, warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights. Neither Snapmaker nor any other party warrants that the functions contained in the Products will meet your requirements or that the operation of the Products will be uninterrupted or error-free. You assume all responsibility and risk for the selection of the Products to achieve your intended results, and for the installation, use, and results obtained from the Products.
(2) You further acknowledge that during device printing, calibration, or operation, you shall not insert body parts or objects into the device interior to avoid potential risks of burns or pinching injuries. You assume all responsibility and risk for any personal injury or device damage resulting therefrom.
(3) You further acknowledge that, to the maximum extent permitted by applicable law, we shall not be liable for any inability to use the Products or for any damages suffered due to any event of force majeure or reasons beyond our reasonable control (such as natural disasters, war, cyber-attacks, government actions, etc.).

To the maximum extent permitted by applicable law, we and our affiliates shall not, under any circumstances, be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, business interruption, loss of data, cost of procurement of substitute products, or damage to goodwill, whether such damages are based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Snapmaker has been advised of the possibility of such damages.
(3) Cap on Liability
To the maximum extent permitted by applicable law, the total liability of Snapmaker to you for all claims (howsoever arising) shall not exceed the purchase price you actually paid for the specific product giving rise to the claim.
(4) Mandatory Legal Provisions
The limitations and exclusions of liability under these Terms apply to the extent permitted by law. They do not affect your statutory rights as a consumer under applicable mandatory laws and regulations. Any provision conflicting with the mandatory laws applicable to these Terms shall be reinterpreted within the scope of such conflict as required by law, and the remaining provisions shall remain in full force and effect.
We provide a limited warranty for Snapmaker devices. Detailed terms can be found in the [Warranty Policy].
You may not use or otherwise export or re-export the Products except as authorized by applicable law and the laws of the jurisdiction in which the Products were obtained. Your use of the Products may be subject to export control and sanctions laws, and you shall comply with all applicable export control and sanctions laws related to the use of the Products.
We reserve the right to modify these Terms at any time. You can find the date these Terms were last effective at the top of the page. Any modifications will be posted on the Snapmaker website or notified to users via email or the Snapmaker App. Your continued use of the Products or services constitutes your acceptance of the updated Terms.

The validity, interpretation, modification, performance, and dispute resolution of these Terms shall be governed by the laws of the mainland of the People's Republic of China.
Any dispute arising from or in connection with these Terms shall be submitted to the Shanghai International Economic and Trade Arbitration Commission / Shanghai International Arbitration Center for arbitration in Shanghai in accordance with its arbitration rules in effect at the time of applying for arbitration. The language of the arbitration shall be Chinese. The arbitral award is final and binding upon the parties.
This provision does not affect any rights you may have under applicable mandatory legal provisions.
These Terms, the Privacy Policy, and other relevant terms, rules, and agreements constitute the entire agreement between you and Snapmaker regarding the use of the Products and shall supersede any prior agreements between you and Snapmaker concerning the use of the Products.
