These Terms of Use (hereinafter referred to as "Terms") constitutes a legally binding agreement between you (an individual, company, or any other entity) and Shenzhen Snapmaker Technologies Co., Ltd., SNAPMAKER HK LIMITED, and any other affiliated entities that may exist now or in the future (collectively referred to as "Snapmaker", "Company", or "us"). These Terms applies to your access and use of the Snapmaker related website, products, software, services, and related resources provided by us, as well as all information and content that appears in the services, including but not limited to 3D model files, text uploaded, downloaded, or saved during the use of the services. Graphics, images, videos, audio, or other materials, services may also include but are not limited to those provided by Snapmaker Provide online shopping malls, model communities, etc.

The clauses in these Terms that restrict your rights and exempt Snapmaker from liability have been specially reminded to you through bold font and other means. Please carefully review and accept or reject the terms of these Terms (if you are under the age of majority, your guardian must agree or represent you in entering into these Terms). If you do not agree to the terms of These Terms, please do not create an account, nor access or use any of the "services" we provide in any other way. If you wish to terminate this contract, you may cancel your account at any time and no longer access or use our 'services'. Your use of these Terms after reading and agreeing to it will be deemed as your complete and unreserved acceptance of all the terms of these Terms.

According to the applicable product return policy, you can return Snapmaker products to the original purchase location, authorized distributor, or retail store where the device was purchased to apply for a refund. Please note that returning to a retail store may be subject to specific return requirements of that store. The product return policy should comply with the relevant laws and regulations of the purchasing country/region.

1. General terms and conditions

1.1 The products referred to in this clause include:

1.1.1 Snapmaker products and services provided by our client Snapmaker Luban/Snapmaker Orca/Snapmaker APP/Snapmaker online store/Snapmaker official website, and Snapmaker 3D models website (collectively referred to as Snapmaker products/services). Software includes but is not limited to code and other embedded software, documentation, interfaces, content, fonts stored on Snapmaker devices, as well as any copyrighted data owned by Snapmaker or its licensors.

1.1.2 Any updates or upgrades to the products referred to in section 1.1.1 and other products or services offered by Snapmaker without a separate user agreement shall be subject to these terms unless otherwise stated.

1.2 Unless otherwise agreed, the software covered by these terms is subject to these terms, whether stored in read-only memory, any other medium, in any other form, or from an online download location authorized by Snapmaker.

2. End user software license

Subject to your compliance with these terms, you are granted a limited, non exclusive license to use the product (as defined in Section 1.1.1) on Snapmaker devices or personal computers and mobile devices. This license is for personal and non-commercial use only, and you are not allowed to sell, transfer, or use the product for any other commercial purposes.

3. Acceptance of Terms

By registering an account within the product or through your actual use of the Snapmaker products/services, you represent that you have fully read, understood, and agreed to be bound by these terms. This clause constitutes a legal document between you and the company and is fully effective.

4. Privacy Policy and Data Use

4.1 Snapmaker Privacy Policy (Privacy Policy) explains how and why we collect, store, and use personal information about users through their access to and use of the service. All personal information provided for accessing and using the service will be processed in accordance with our privacy policy. Users understand that by accessing and using the service, they agree to our collection and use of such information in accordance with the privacy policy.

4.2 If you choose to join our User Experience Improvement Program to help improve our products and services, we will collect data from your products/devices for analysis, including your device configuration data, application statistics data, and error log data, as described in our Privacy Policy. We will conduct de identification or anonymization processing before using relevant data. You can follow the product related page operation instructions or contact us to choose to exit the user experience improvement plan.

4.3 Please note that the privacy policy may be updated regularly, and any changes will take effect when we publish the revised privacy policy. The continued use of the service by the user shall be deemed as acceptance of the then effective privacy policy terms. Therefore, we recommend that users regularly review the latest privacy policy to understand the latest measures we take to protect or use user information.

5. Account registration and security

5.1 To use Snapmaker products/services, you may need to create a Snapmaker Universal Account (hereinafter referred to as a "User Account") as a registered user, which will include a username and password (collectively referred to as "Login Information"). If you create a user account, you agree to provide a valid mobile phone number that you own and use, as well as other information required to complete the user account registration process.

5.2 When creating an account, you must provide accurate, truthful, legal, and valid information as required. If the materials or information you submit are inaccurate, untrue, or do not meet the requirements, or if we have reasonable grounds to suspect that they are incorrect, false, or illegal, we reserve the right to refuse you access to the relevant functions or services. Therefore, you may not be able to use the product or related services, or certain features may be restricted. You are fully responsible for the accuracy, confidentiality, and security of your account information.

5.3 User accounts can also be used through your existing Snapmaker account services (such as registered accounts with Snapmaker) or third-party account login (such as WeChat,Weibo,QQ,Apple ID account,Google ID account, etc.). If you use the Snapmaker account service or connect your third-party account through a third-party login tool, you also need to comply with the applicable terms and conditions.

5.4 You shall not share your account with others or use it for any illegal or unauthorized purposes. You are fully responsible for maintaining the security of your user account and login information, as well as any activities or behaviors that occur under your user account. You are responsible for keeping your password confidential and immediately notifying us if it is leaked. If the above situation is caused by your personal fault, Snapmaker will not be held responsible.

Snapmaker is not responsible for any losses caused by unauthorized use of your user account. Snapmaker will maintain the security of information in accordance with the law, but this does not mean that we can identify any illegal or unauthorized use of your account and password under any circumstances. If the above situation is caused by your personal fault, Snapmaker will not be held responsible.

5.6 You agree not to share, license, sell or transfer your user account or any part of your account.

5.7 You understand and agree that if Snapmaker discovers that you have violated laws and regulations, as well as the provisions of these Terms, Snapmaker has the right to take measures such as prohibiting re registration, warning reminders, deleting information, prohibiting the publication of information, stopping the transmission of information, restricting/suspending or freezing the checkout account function until permanent account suspension/service cessation, depending on the situation.

6. Service Usage Rules and Code of Conduct

6.1 Snapmaker website

6.1.1 The Snapmaker website provides product information, online purchasing, 3D models,and user support services. When using the website, you agree not to engage in any illegal, fraudulent, or destructive behavior.

6.1.2 We reserve the right to modify, suspend or terminate any part of the website at any time without prior notice.

6.2 Snapmaker Community

6.2.1 Users understand and acknowledge that Snapmaker prohibits you from engaging in illegal activities or from creating, publishing, uploading, copying or distributing illegal/harmful information in the Snapmaker community.

6.2.2 Users also need to comply with laws and regulations and relevant rules published by Snapmaker.You should independently manage the comments, replies, and other content under your posted content. If you discover illegal and/or harmful content, you should take proactive measures such as reporting and deleting it.

6.3 Snapmaker devices and Warranty Policy

6.3.1 When purchasing and using Snapmaker devices, you should comply with the accompanying user manual, safety instructions, and local laws and regulations.

6.3.2 You agree to operate the device legally and safely in accordance with the product instructions, and not to use the device for any illegal purposes or violate these terms.

6.3.3 Regarding the use of Snapmaker devices, you should refer to Snapmaker “Warranty Policy” (Warranty Policy | Snapmaker Wiki). We provide warranty services within the scope permitted by law and may impose reasonable restrictions on the use of the equipment.

6.4 Snapmaker Software and Firmware

6.4.1 You acknowledge and agree that Snapmaker Luban, Snapmaker Orca software, and product firmware contain customized development based on open source projects (including but not limited to Klipper, Orca Slicer, etc.), which are subject to their respective open source license agreements.

6.4.2 The use of open source software should strictly comply with the applicable license terms. Each software package comes with a license text, please read it carefully.

6.4.3 Under the premise of complying with relevant open source licenses, you may modify the corresponding code. Please note: Installing custom firmware itself does not void the product warranty, but any damage caused by installing or using custom firmware is not covered by the warranty. We do not assume any responsibility for any software or hardware failures, data loss, or other damages caused by users modifying firmware.

6.4.4 In addition to the aforementioned open-source components, this software (including but not limited to Snapmaker firmware, GUI, System management services, camera services, remote connection services, upgrade services, and product information management services) is a proprietary component of Snapmaker. We grant you a personal, non exclusive, non transferable license to use such proprietary software on Snapmaker devices. For this proprietary component, you agree not to engage in the following behaviors:

6.4.5 Copying, modifying, creating derivative works, decompiling, reverse engineering or disassembling software, or attempting to extract source code from software;

6.4.6 Sell, rent, lend, sublicense or distribute our software without authorization;

6.4.7 Delete, conceal or tamper with any copyright, trademark or other proprietary statements contained in the software;

6.4.8 Avoid any technical protection measures contained in the software.

6.5 Snapmaker App

6.5.1 The Snapmaker App provides device management and operation functions. When using the app, you agree to comply with all relevant terms and conditions.

6.5.2 Through the Snapmaker App, users can monitor device status, perform remote control, manage design files, and access supporting resources. When using these features, you should ensure safe operation and avoid any behavior that may cause equipment damage or security risks.

6.5.3 We reserve the right to modify, update, or discontinue certain features of the Snapmaker App at any time without prior notice. You should regularly check the update information within the app to ensure that you have the latest features and user experience.

6.6 Snapmaker Services

6.6.1 We provide various customer services, such as technical support and warranty services. When using these services, in addition to these terms, you should comply with the relevant service terms and use the services reasonably.

6.6.2 We reserve the right to interrupt or refuse to provide services, especially when we discover that users have abused or violated these terms or related service terms.

6.7 Users understand and acknowledge that the following violations are prohibited when using Snapmaker related services:

6.7.1 Creating false identities on Snapmaker, creating accounts for anyone else, using other people's accounts, etc;

6.7.2 Disrupting any security features of Snapmaker products or services, bypassing or circumventing any access controls or service usage restrictions of Snapmaker products or services, including but not limited to illegal intrusion, interference or destruction of Snapmaker products or services, servers, networks connected to Snapmaker products or services;

6.7.3 Develop, support or use software, devices, scripts, automated programs or any other methods or means (such as crawlers, browser plugins and add ons or any other technology) to collect or copy data from Snapmaker products or services, and delegate or assist others in obtaining Snapmaker's services, content, data;

6.7.4 Infringement of intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. For example, without the permission of others, it is not allowed to copy or disseminate others' models or content;

6.7.5 Other behaviors that violate laws and regulations, public order and good customs, these Terms, and infringe upon the legitimate rights and interests of others.

7. User content and licenses

7.1 "User Content" refers to any and all information and content submitted by users to or used with our website or service (such as user profile content, user created 3D models, etc.), including but not limited to any modifications, improvements, or changes made to any print profiles, modes, or settings created by you using Snapmaker products.

7.2 You are fully responsible for your user content and assume all risks related to the use of your user attributes. Unless otherwise stated in written documents provided by Snapmaker, you may not declare or imply that your user content is provided, sponsored, or endorsed by Snapmaker in any way. If the content you upload and publish is generated by artificial intelligence/AI, you need to add relevant labels according to relevant laws and regulations. Otherwise, you should bear the relevant responsibilities on your own.

7.3 If there is reason to believe that user content infringes or may infringe third-party intellectual property rights (including copyrights, patents, trademarks, trade secrets, or other proprietary rights), Snapmaker has the right to take necessary measures such as temporary or permanent deletion, blocking, etc. to handle the relevant user content.

7.4 The user reserves all intellectual property rights that they may have in the user content. Snapmaker does not own user content.

Snapmaker is not obligated to back up any user content, which may be deleted at any time.

Snapmaker does not provide any licenses to other users for user content. When you upload certain user content to the Snapmaker website or service, you need to specify the license type, which includes but is not limited to Creative Commons Licenses. Please refer to https://www.creativecommons.org ). The license type you choose will guide other website or service users on how to use your user content. Publishing user content through Snapmaker's website or service is considered as the user proposing to other users to enter into a license agreement based on the selected license terms. The user understands and acknowledges that once the user's content is published, the relevant license is irrevocable. Although we may inform other users, website, application or service users of your license and require compliance with the terms of such license, you acknowledge that we are not responsible for enforcing this license, and we cannot guarantee that other website or service users will indeed comply with the license you have chosen.

7.7 When uploading and publishing user content through our website or service, the user declares and warrants that they have all the necessary rights to further distribute, license, or sublicense to Snapmaker and other users, and this operation is based on the user's self selected license.

7.8 You hereby grant, and you represent and warrant that you have the right and agree to grant Snapmaker an irrevocable, free, and non exclusive license worldwide with respect to the user content you publish, including but not limited to the right to sublicense, use including but not limited to copying, distributing, publicly displaying and performing, and integrating into other works. The aforementioned license shall continue until the end of the exclusive rights period of the user content. Snapmaker may use and sublicense user content for operational needs, promotion of services, and other Snapmaker services.

7.9 The user understands and agrees that user content is created, uploaded, and published by users who use our services. Apart from complying with relevant laws and regulations, Snapmaker will not review or control user content in any form. Snapmaker does not provide any guarantee, warranty, or compensation for user content, and is not responsible for any damages suffered by users as a result of using user content published through the service.

7.10 Regarding any feedback on user content, we can be notified via email address info@snapmaker.com, or if there is a "report" button provided for specific user content or other user content, the button can be used for reporting.

7.11 For all complaints involving unauthorized content (including user content), if a specific user content or other user content provides a "copyright appeal" button, you can report it through this button. You need to provide original links, problem descriptions, proof of ownership, and evidence of infringement. Failure to provide this information may result in your complaint being rejected.

7.12 Although Snapmaker allows users to upload and store content, Snapmaker itself is not a website/product specifically designed to store information. Snapmaker will make reasonable commercial efforts to protect, backup, and restore user content, but Snapmaker is not responsible for the security of any user content, and is not responsible for any damages caused by user content.

8. Intellectual Property

8.1 Without our prior written permission, you may not use our technology or intellectual property (including patents, trademarks, software, and firmware) to develop, design, manufacture, or sell devices, software, or third-party accessories that compete with Snapmaker products.

8.2 For the open source software we provide, you may exercise your rights in accordance with the terms of the open source license, but you may not infringe upon our brand or intellectual property rights. You are not allowed to use our name or logo for commercial promotion without authorization.

8.3 You understand and agree that you are fully responsible for the copyright legality of all models processed through Snapmaker products.

8.4 Snapmaker reserves all intellectual property rights in its products or services. The data, software programs, services, trademarks, and all designs, elements, etc. related to the product or service are provided by Snapmaker and are protected by intellectual property and other relevant laws. Users are not allowed to use these materials unless expressly authorized by Snapmaker.

8.5 Without prior permission from Snapmaker, no third party shall use website, product, or service data or information, including but not limited to copying, downloading, crawling, or mining, from the website, product, or service, whether for commercial purposes or not.

8.6 Snapmaker explicitly prohibits the use of any artificial intelligence/AI tools to crawl, copy, download, or exploit content published on the platform. Without authorization from the content author, users or any third party are prohibited from crawling, copying, downloading, or utilizing user content from websites, products, or services, including but not limited to 3D model files, text, graphics, images, videos, audio, or other materials.

9. Export control

Unless authorized by applicable laws and the laws of the jurisdiction where the product is located, you may not use or otherwise export or re export the product. Your use of the product may be subject to export control and sanction laws, and you should comply with all applicable export control and sanction laws related to the use of the product.

10. Reward Program

10.1 Snapmaker may periodically organize events for users, such as distributing coupons and other rewards. Coupons and other rewards are issued by Snapmaker for users to redeem cash discounts or rebates when purchasing community products. Buyers should carefully review the relevant activity agreement and comply with the activity rules when participating in the event. Any behavior of obtaining coupons and other rewards through illegal means is strictly prohibited.

10.2 Snapmaker reserves the right to modify, remove, or terminate any terms or policies related to the reward program.

10.3 If we have objective reasons for your violation of relevant regulations, we may suspend or completely terminate your access to the reward program or rewards without prior notice.

10.4 We may also partially or fully terminate or suspend a reward program upon reasonable notice to you.

11. Product updates

11.1 In order to continuously provide you with improved user experience and device performance, we may regularly provide product updates, including but not limited to system software updates, firmware updates, and other functional improvements. This type of update aims to enhance product performance, security, and reliability. Updates may be delivered through various methods, including online downloads or manual installations. The updated content may include error fixes, performance improvements, security patches, and new features.

11.2 Any replacement or supplementary product updates we provide are subject to these terms, unless the update is accompanied by a separate usage agreement, in which case the terms of that agreement shall prevail. If you choose not to install the update, you understand and agree that this may result in potential security risks or inability to use certain features of the product. Snapmaker is not responsible for performance degradation or security risks caused by failure to install updates.

11.3 To maintain the stability of the product, the product may automatically check the available updates when connected to the Internet, and download and install them after receiving your authorization.

12. Product Services

12.1 The product may enable you to access relevant Snapmaker and third-party applications and services (collectively or individually referred to as "Services"). However, due to the regional nature of certain services, they may not be available in all languages or regions. Some features may vary by region, some features may be restricted, or your service provider may not provide them. In addition, you understand and agree that the availability of certain features of the product may also be affected by hardware and data access restrictions, and may not be available on all products.

12.2 To ensure and enhance your user experience, the product includes system services. The specific content of services under the product will be provided by Snapmaker and its affiliated companies/licensors based on the actual situation. Snapmaker and its affiliates/licensors may modify the services they provide, and the content of the services provided may change at any time.

12.2.1 Cloud Services: This provides you with the basic functionality to use Snapmaker cloud services. These basic functions include Snapmaker account management, wireless print sending, and remote monitoring. These features may not be available in all regions/countries or all languages. Using these basic features requires an Internet connection and requires you to register for a Snapmaker account and accept the additional terms of these basic services.

12.2.2 Health Management System: The health management system is a service that automatically diagnoses the health status of equipment. You can use this system to discover and check the current working status of various components of the device, and view solutions to any problems encountered. However, you understand that due to technical limitations and various other reasons, Snapmaker cannot guarantee that the above features can fully and accurately detect all issues.

12.2.3 Printing result detection: Printing result detection automatically detects problems that occur during the actual printing process, including failed printing (such as spaghetti) detection. By using these services, you can provide check prompts in case of printing issues and automatically stop printing when serious problems occur. However, you understand that due to technical limitations and various other reasons, we cannot guarantee that the above features can fully and accurately detect issues, and there may be a risk of erroneous detection in special circumstances.

13. Third party software declaration

You clearly understand and agree that the product supports the execution of standard G-code files, but does not guarantee that G-code generated by third-party software will always be available. In addition, we are not responsible for any product damage caused by running G-code generated by third-party software on the product.

14. Disclaimer

14.1 You confirm that the product is provided "as is" without any express or implied warranties. To the maximum extent permitted by applicable law, Snapmaker、 The licensor/affiliate or copyright holder denies all express or implied representations and warranties, including but not limited to warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non infringement of third-party rights. Snapmaker or any other party does not guarantee that the features included in the product will meet your requirements, or that the operation of the product will be uninterrupted or error free. You assume full responsibility and risk for selecting the product to achieve the expected results, as well as for the installation, use, and acquisition of the product.

14.2 You further confirm that during the printing, calibration, or operation of the device, you must not insert any body parts or objects into the interior of the device to avoid potential burn or pinch risks. You bear full responsibility and risk for any personal injury or equipment damage resulting from this.

14.3 You further confirm that, to the maximum extent permitted by applicable laws, we shall not be liable for any inability to use the product or any damages suffered due to any force majeure event or reasons beyond our reasonable control (such as natural disasters, wars, cyber attacks, government actions, etc.).

15. Limitation of Liability

15.1 Exemption from Liability

To the maximum extent permitted by applicable law, we shall not be liable for any damages caused by any of the following circumstances:

a. You abuse, misuse or modify the product without authorization (including but not limited to flashing unofficial firmware);

b. Equipment damage or printing failure caused by your use of third-party consumables, accessories, or software;

c. The results generated by following the printed file or instructions you provided.

15.2 Exclusion of Indirect Damage

To the maximum extent permitted by applicable law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, data loss, purchase costs of substitute products, or damage to goodwill, under any circumstances, whether based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Snapmaker has been informed of the possibility of such damages.

15.3 Liability Limit

To the maximum extent permitted by applicable law, Snapmaker's total liability for all claims (however arising) against you shall not exceed the actual purchase price you paid for the specific product that gave rise to the claim.

15.4 Mandatory Legal Provisions

The limitation and exclusion of liability under this clause shall apply to the extent permitted by law. They do not affect your legal rights as a consumer under applicable mandatory laws and regulations. Any provisions that conflict with mandatory laws applicable to this clause shall be reinterpreted in accordance with legal requirements within the scope of such conflict, and the remaining provisions shall remain fully effective.

16. Amendment of Terms

We reserve the right to modify these terms at any time. You can find the last effective date of these terms at the top of the page. Any modifications will be published on the Snapmaker website or notified to users via email, Snapmaker App, or Snapmaker Space. By continuing to use the product or service, you accept the updated terms.

18. Applicable Law and Dispute Resolution

The validity, interpretation, modification, performance, and dispute resolution of this clause shall be governed by the laws of mainland China.

Any dispute arising from or in connection with this clause shall be submitted to the ShenZhen Arbitration Commission for arbitration in Shenzhen in accordance with the effective arbitration rules at the time of application for arbitration. The language of arbitration shall be Chinese. The arbitration award is final and binding on both parties.

This regulation does not affect any rights you may have under applicable mandatory legal provisions.

19. Complete terms and conditions

These terms, privacy policy, and other related terms, rules, and agreements constitute the entire agreement between you and Snapmaker regarding the use of the product, and shall supersede any prior agreements between you and Snapmaker regarding the use of the product.
